Constitutionalist experts discuss Law 2/2023 at the Center for Political and Constitutional Studies in a co-organized day with the AIPI

The day of debate “Three years of validity of Law 2/2023” allowed constitutional experts and the authorities in matters of protection of the informant to discuss the development of the law and its challenges, to guarantee the protection of the informants throughout the territory.

“Three years of validity of Law 2/2023” was the starting point of the day of debate that, with the same name, gathered yesterday in Madrid, in the facilities of the Center for Political and Constitutional Studies (CEPC), constitutional experts, officials of the competent authorities for the protection of the informant person, and public and private organizations interested in the matter.

The day of debate was inaugurated by the president of the AIPI, Manuel Villoria, and the director of the Center for Political and Constitutional Studies, Rosario García. In his speech, Manuel Villoria indicated that proposals have been presented from Spain to improve Directive 2019/1937 of the European Parliament and of the Council, of 23 October 2019, on the protection of individuals who report infringements of Union law. He added that, in agreement with the autonomous authorities, a reform of Law 2/2023, of February 20, has been proposed, regulating the protection of people who report on normative violations and the fight against corruption.

The participants in the different tables addressed essential issues for the protection of the informants, such as the agreements with the Autonomous Communities that lack competent authority, or how the various tools provided by the law should be articulated so that the infractions included in Law 2/2023, of February 20 can be communicated.

The first table was moderated by the Manager of the AIPI, María José Gómez, who proposed to the professor of Constitutional Law Javier Sierra and the professor of Criminal Law Silvina Bacigalupo various issues related to the challenges and proposals for better protection of the informant.

Next, the Director of the Monitoring and Sanctioning Regime Department, Teresa de Jesús Sánchez, moderated the debate on the autonomous reality three years after Law 2/2023, of February 20, between Josep Tomás Salas and Francisco de Paula Sánchez, directors of the Catalan and Andalusian offices, respectively.

In the third table participated the professors of Constitutional Law Manuel Medina and Tomás de la Quadra-Salcedo, with the moderation of Flora Pérez, Deputy Director General of Legislative Policy of the Ministry of the Presidency, Justice and Relations with the Courts.

The head of the final conference was the former Minister of Justice and Professor of Constitutional Law Francisco Caamaño, who spoke on “A vision of Law 2/2023 from the policies of compliance in the private sector’.
