Law 2/2023 includes the typification of those actions or malicious omissions considered as infringements that may carry a penalty.
Classification:
- Very serious: behaviours that seriously impede the protection of the informant or the functioning of the system (e.g. : serious retaliation, destruction of evidence).
- Serious: Relevant breaches in the implementation or management of the system; significant breaches of confidentiality.
- Minor: Formal or minor breaches in the management of the channel or in public information about the system.
Prescription
Very serious infringements will be prescribed at three years, severe infringements at two years and mild infringements at six months.
