Notification of the appointment or dismissal of the RSII

Private sector

The appointment and dismissal of the System Manager must be notified to the AIPI in the following cases:

  • In the case of private sector natural or legal persons having employed fifty or more workers or private sector legal persons falling within the scope of the European Union acts referred to in Article 10.1.b), and having establishments in more than one Autonomous Community.
  • When the obliged entity has an establishment in a single Autonomous Community that does not have autonomous authority with sanctioning powers of Title IX of Law 2/2033 in the private sector.

Political parties and trade unions

In the case of political parties and trade unions, both the appointment and the dismissal of the RSII must be notified to the AIPI:

  • When its scope of action is national or extends to more than one autonomous community.
  • When its scope does not exceed the territory of an autonomous community and in that community there is no autonomous authority with punitive powers in matters of protection of the informant in the private sector, in accordance with the provisions of Title IX of Law 2/2023.

Public sector

In the public sector, all entities of the state public sector to which the AIPI refers must notify the AIPI, both the appointment and the cessation of its System Manager. Article 13 of Law 2/2023.

Likewise, the notification to the AIPI must be made by the public sector entities of those autonomous communities that do not have an operational autonomous authority with sanctioning powers of Title IX of Law 2/2033 in the field of the public sector (currently, Aragón, Asturias, Baleares, Canarias, Cantabria, Extremadura, Region of Murcia, Basque Country, La Rioja, in addition to the Cities of Ceuta and Melilla).

How and when to notify the appointment or cessation of the RSII

The appointment or dismissal of the System Responsible must be communicated to the Independent Authority for the Protection of the Informant (AIPI) - or the competent authority - within a maximum period of 10 working days from its occurrence.
