Sanctions

Types of Sanctions

Las sanctions envisaged Law 2/2023 classifies them as follows:

  • Fines: Fines may be imposed with differentiated amounts according to gravity; the law establishes margins and criteria for their imposition.
  • Additional measures: In case of very serious infringements, additional measures may be imposed, Such as a public warning, a ban on obtaining subsidies or tax benefits, or a ban on contracting with the public sector.

Responsible subjects

They are subject to the sanctioning regime. natural and legal persons that they commit the behaviors typified as infractions in Law 2/2023; the responsibility can be demanded of those responsible even if the relationship with the entity has ceased.

The sanctions, after the determination of the administrative decision, can be published in the Official State Gazette (BOE) in the cases provided for

Criteria for graduation

The penalties to be imposed shall be graduated taking into account the nature of the infringement and the concurrent circumstances in each case.

Among the graduation criteria There are some such as the seriousness of the event, its intentionality, the economic result obtained, the recidivism, the damage caused and its repair.

Prescription

The law establishes different deadlines depending on the nature of the infringement.
